Retired officer charged over death threats to wife

By TONY MUSISI

A retired senior agricultural officer who allegedly threatened to kill his estranged wife over domestic issues has been charged before an Eldoret court.

Moses Ndiema, who was stationed in Elgeyo Marakwet County during his service, appeared before Senior Resident Magistrate Beatrice Toroitich, where he faced two charges.

According to the charge sheet, the offence of threatening to kill was allegedly committed on August 1, 2026, at Willow Tree area in Moiben Sub-County, Uasin Gishu County.

Ndiema is accused of threatening to kill his estranged wife, Helizeba Kemboi, contrary to Section 223(1) of the Penal Code.

The charge sheet states that Ndiema, without lawful excuse, allegedly uttered the words, “Nitakuuwa wakati wowote.”

He faced a second charge of assaulting Kemboi on the same date and at the same place, thereby occasioning her actual bodily harm.

Ndiema, who was unrepresented in court, denied both charges.

He pleaded with the magistrate to release him on reasonable cash bail, saying he was recovering from a head injury and was also experiencing pain in one of his teeth.

“Your honour, I underwent a head operation recently in a hospital and am still recovering. I am also supposed to see my doctor to review one of my teeth, which is in pain,” Ndiema told the court.

He further assured the magistrate that he was not a flight risk and would attend court whenever required.

This came after the magistrate granted him a Sh100,000 bond without an option of cash bail.

She directed that Ndiema be escorted to Eldoret GK Prison if he failed to raise the bond.

However, after Ndiema pleaded with the court to reconsider the terms, the magistrate reviewed her decision and granted him an option of Sh80,000 cash bail.

He raised the cash bail and was released from custody less than 30 minutes later.

The magistrate directed that the case be mentioned on December 1, 2026.
